Welcome to JendAKJaay. Protecting your personal data is a priority for us. This privacy policy describes the types of information we collect, how we use, share, and protect it, as well as your rights regarding your data. This Privacy Policy applies to the website https://www.JendAKJaay.com and its subdomains, as well as its applications, regardless of how you access the services.

By using our Service, you expressly agree to the terms set forth in this policy.

By using or interacting with https://www.JendAKJaay.com and its services, you enter into an agreement with us and agree to have your information collected, used, processed, and stored in accordance with this Privacy Policy and our Terms and Conditions of Use.

“JendAkJaay” or “Jendakjaay”), a company registered in Senegal and based in Dakar, collects, uses, shares, and protects user information in connection with the use of its JendAkJaay mobile application and associated web services (collectively, the “Platform”).

JendAkJaay is a solution that allows private and  professional entities (“Buyers and Sellers”) to advertise by publishing and selling their products to customers (“Buyers and Sellers”).

You can visit our site without registering an account. However, when you choose to provide us with your personal data, you consent to that information being sent to and stored on our servers. Here are the types of information we collect:

Your privacy is of paramount importance to us. We are committed to protecting your personal data and treating it with the utmost transparency, in accordance with the legislation in force in Senegal.

By using our Platform, you agree to the practices described in this Privacy Policy

and the privacy policies of our partners Naboopay, Paydunya, Unitechpay (for payment services) and miniOrange Gateway SMS (for messaging services).

IP address, device type, network and computer or phone performance

Statistics on the number of page views, traffic to and from the site, ad data

Information collected via cookies, web beacons, and other similar technologies to collect browsing information: we obtain your consent for the use of cookies and trackers, in accordance with CDP requirements

Location data related to your device

Additional information provided via sharing platforms and social networks, only with your explicit consent and in accordance with the specified purposes.

Information provided when registering for services (first name, last name, date of birth, location, WhatsApp number, phone number, etc.).

Data from other sources: we may receive or collect additional information about you from other integrated services and integrate it with your Account information. This information may include, but is not limited to: demographic data, browsing data, data on additional contacts, and additional data about you from other sources, such as public authorities, within the limits of applicable regulations.

We undertake, in particular, to enter into written contracts with our subcontractors, stipulating their obligations in terms of security and confidentiality of personal data, and requiring them to act only on our instructions, in accordance with Articles 39 and 70 of Law No. 2008-12 and the recommendations of the CDP law No. 2008-15 of 24 January 2008.

4. Data Retention

Personal data is retained in accordance with Senegalese law on the protection of personal data.

Retention periods:

Account data: retained until the account is closed.

Transaction data: retained for tax and compliance purposes for 10 years, in accordance with legal obligations to retain accounting documents.

Account data: (identity, electronic contact details, history of use of the Service) is retained for 10 years from the end of the commercial relationship, for legitimate reasons of commercial monitoring and management of any disputes.

Data relating to the management of your Account and your Advertisements is retained for a period of 10 years from the date of its deletion, exclusively for evidence purposes.

Accounting data: kept for 10 years as accounting evidence.

Data that may be subject to a court order (connection data, identity, contact details, transaction data) is kept for 10 years from the date of collection.

5. User rights

In accordance with Senegalese law on the protection of personal data, you have the following rights:

Right to prior information: you have the right to be informed in a clear and comprehensive manner about the collection and processing of your personal data, including the identity of the data controller, the purposes, the categories of data, the recipients, and the retention period.

Right of access: you may request confirmation that your data is being processed and obtain an accessible copy of this data.

Right to rectify incorrect data: you may request that your inaccurate or incomplete data be corrected, completed, or updated.

Right to erasure of data (right to be forgotten): you may request the deletion of your personal data, particularly if its storage is prohibited.

Right to object to the processing of your data: you have the right to object, on legitimate grounds, to the processing of your data, in particular for direct marketing purposes.

6. Data Security

We implement technical and organizational security measures to protect your personal data against loss, misuse, and unauthorized access, in accordance with Article 71 of Law No. 2008-12. These measures include:

Data encryption:

Strict access controls: we ensure that only persons authorized by virtue of their duties have access to the relevant personal data, and that their identity can be verified and recorded (access traceability)

All communications between the mobile or web application and our servers are encrypted via HTTPS

Access to data internally is restricted to JendAkJaay employees who need it to perform their administrative duties.

However, no method of transmission over the Internet is 100% secure. The Seller is also

responsible for the security of the device used to access the Platform, as is the buyer

Regular security audits:

Protection of premises and equipment: we prevent unauthorized persons from accessing the premises and equipment used for data processing

Data backup and integrity: we take measures to prevent unauthorized reading, copying, modification, destruction, or removal of data media, and we make regular backup copies. Stakeholder awareness: we make our staff and partners aware of data security and confidentiality rules

7. Data Retention Period

We retain your personal data for a limited period of time, not exceeding that necessary for the purposes for which it was collected.

Seller Data: Data is retained for as long as the account is active. In the event of a request to delete an account, we conduct a 30-day audit (in particular to finalize any ongoing transactions and disputes). After this period, personal data is permanently deleted, subject to our legal obligations (e.g., for accounting purposes).

Buyer Data: Data is retained for the time necessary to complete the order, manage any disputes, and fulfill the legal warranty period. It is then anonymized or deleted.

8. Policy regarding Minors

The creation of a Seller account and the use of the Platform for sales purposes are strictly reserved for persons aged 18 or over. We do not knowingly collect data from persons under the required age. If we learn that an account has been created by a minor, we

will take the necessary steps to delete it.

9. International Data Transfers

The personal data processed by JendAkJaay is hosted on secure servers located in

Germany (Berlin), via our hosting provider Strato.

Our technical partners Naboopay, Paydunya, Unitechpay (for payment services) and miniOrange Gateway SMS, may also store or process data outside the national territory.

In all cases, we ensure that these transfers comply with legal obligations regarding

personal data protection. (But also check their own policies)

If your data is transferred outside Senegal, we will ensure that adequate protective measures are in place, in accordance with applicable legislation. Such transfers will only be made if the third country ensures an adequate level of protection for the privacy and fundamental freedoms of individuals, or if sufficient guarantees are provided by the data controller. The Personal Data Commission will be informed prior to any transfer, in accordance with Articles 49 and 51 of Law No. 2008-12.

10. Ethical Commitment

JendAkJaay is committed to complying with Senegalese ethical principles relating to the processing of personal data. The data collected will never be used for political,

discriminatory, illegal, or contrary to Senegalese values and ideals purposes.

12. Changes to the Privacy Policy
